This phD research on the scope of Article 8 of the ECHR (European Convention on Human Rights) concentrates on the question how the scope of human rights is shaped by judicial or quasi-judicial bodies.
More specifically, it examines the legal techniques or modes of reasoning employed by the European Court of Human Rights and the former European Commission of Human Rights when determining the scope of Article 8 of the European Convention on Human Rights.
This PhD research is conducted in the framework of the project sponsored by the European Research Council. “Strengthening the European Court of Human Rights: More accountability through better legal reasoning”, ERC Starting Grant of prof. Eva Brems.
