Legislating with the best intentions? Judicial review of the legitimacy of the legislator’s aims

This research project is positioned at the intersection between constitutional law and human rights law and focuses on the judicial review of the legitimacy of the aims pursued by the legislator and is aimed at developing a theoretical framework therefor, through a comparative analysis of the American, ECtHR and Belgian administrative adjudicative practice. This framework will subsequently be tailored to the context of the Belgian Constitutional Court, the existing approach of which will be studied extensively as well.
